We recently acted for the applicants in a Class 1 appeal before the Land and Environment Court of New South Wales (NSWLEC) against Mosman Municipal Council’s refusal of a modification application to their development consent. The dispute centered on claims that the proposed changes would increase visual bulk, increase streetscape character, and reduce landscaping dominance.
Background
Our clients own a prominent residential property with extensive waterfront views, and were seeking to refine their approved development. These proposed additions included relocating a small portion of internal floor space, slightly enlarging the internal spaces, and replacing a previously approved open pergola with a driveway awning. Despite these modifications being modest, and designed to enhance the property’s appearance, Council contended that they would disrupt the streetscape, leading to a refusal of the application.
Proceedings
Appeal proceedings commenced in the NSWLEC under s 8.7 of the Environmental Planning and Assessment Act 1979, and following a conciliation conference under s 34AA of the Land and Environment Court Act 1979, proceeded to a formal hearing. Council maintained that the modifications would exacerbate the already significant bulk of the dwelling and diminish the predominance of landscaping over built form, contrary to the Mosman Local Environmental Plan 2012 and Mosman Development Control Plan 2012. Conversely, expert evidence demonstrated that the modifications preserved the approved floor space and height while incorporating additional landscaping to mitigate bulk concerns.
Judgment
The Court found that the changes aligned with the established character of the streetscape, and enhanced the property’s aesthetic and environmental performance. This outcome underscores our firm’s navigation of complex planning disputes and advocating for clients facing unreasonable council determinations.
